2. For what purposes and on what legal basis is the data being processed?

The collection of this data takes place to:

  • identify you as an applicant;
  • contact you;
  • carry out the application process

The data processing is initiated by your request and is in accordance with Art. 6 para.1 s.1 lit.b GDPR in conjunction with Art. 88 GDPR in conjunction with § 26 Bundesdatenschutzgesetz (BDSG), as well as all other pertinent laws such as the Allgemeines Gleichbehandlungsgesetz (AGG). Furthermore, consent under Art. 6 para.1 s.1 lit.a, 7 GDPR in conjunction with Art. 88 GDPR in conjunction with § 26 para.2 BDSG may serve as a legal basis.

In the case of processing special categories of personal data according to Art. 9 GDPR, this is to exercise rights or fulfill legal obligations from labor law, social security law, or social protection. The legal basis here is Art. 9 para.2 lit.b GDPR in conjunction with Art. 88 GDPR in conjunction with § 26 para.3 BDSG.

Consent to process special categories of personal data is based on Art. 9 para.2 lit.a, Art. 6 para.1 s.1 lit.a, 7 GDPR in conjunction with Art. 88 GDPR in conjunction with § 26 para.3, para.2 BDSG.

We have a legitimate interest in identifying you as an applicant according to Art. 6 para.1 s.1 lit.f GDPR.

 

3. Who receives my data?

If necessary for the handling of the application process with you, your personal data is passed within our company to the relevant persons and, if applicable, departments for review; these especially include the human resources department and the specific department.

No further transfer of data to third parties occurs.

 

4. Which data protection rights can I assert as an affected person?

You have the right:

  • in accordance with Art. 7 para.3 GDPR, to revoke any consent you have given us at any time. This means we may not continue the data processing based on this consent in the future; to exercise your right of withdrawal, an email to datenschutz@beegy.com is sufficient. If you revoke your consent, we may no longer be able to perform the services agreed upon to the desired extent;
  • in accordance with Art. 15 GDPR, to request information about your personal data processed by us. You can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been disclosed, the planned storage duration, the existence of a right to correction, deletion, limitation of processing or opposition, the right to lodge a complaint, the source of your data if they were not collected from us, and about the existence of automated decision-making including profiling and, if relevant, meaningful information about the details thereof;

     

  • in accordance with Art. 16 GDPR, to demand immediately the correction of incorrect or complete your personal data stored by us;
  • in accordance with Art. 17 GDPR, to demand the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, for the performance of a legal

    obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims;

  • in accordance with Art. 18 GDPR, to demand the restriction of processing of your personal data, provided the conditions of Art. 18 GDPR are met;
  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format or to request the transfer to another controller;

 

5. Can I object to the processing of my personal data?

You have the right, for reasons arising from your particular situation, to object at any time to the processing of your personal data based on Art. 6 para.1 s.1 lit.e or lit.f GDPR. We will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims.

If you wish to exercise your right to object, an email to datenschutz@beegy.com is sufficient. In case of an objection, we may no longer be able to provide the agreed services or not to the desired extent.

 

6. Do I have the possibility to lodge a complaint?

If you believe that the processing of your personal data by us is unlawful or violates data protection law for other reasons, you can lodge a complaint with a supervisory authority. You can approach an authority in the Member State of your residence, your place of work, or the place of the alleged violation.

 

7. How long will my personal data be stored?

Your personal data collected for the application process will be deleted four months after sending a rejection unless you have consented to us keeping your data longer, for example for inclusion in an applicant pool.

In some cases, personal data may need to be stored for a period because we have to defend against legal claims.

 

8. Will my personal data be transmitted to a third country?

 

No transfer to third countries occurs.

 

9. Am I obliged to provide my data?

There is generally no legal obligation to provide your personal data. Refusal to provide it will not have any adverse legal consequences.

However, if you submit your application to us, you initially provide your data on a voluntary basis. Within the framework of the application process, it is necessary for you to provide your data for the proper conduct of the process. Data processing for the purpose of initiating an employment relationship is legally regulated under § 26 para.1 s.1 BDSG in conjunction with § 26 para.8 s.2 BDSG. If you do not provide us with the data, we will unfortunately not be able to consider your application further.

 

10. Do automated individual decisions or profiling measures take place?

No automated individual decisions or profiling measures are taken to fulfill contractual obligations.
